Terms of Service

The terms of this agreement (“Terms of Service”) govern the
relationship between you and Nanoreality Games Limited and its affiliates (hereinafter
“Nanoreality” or “Us” or
“We”) regarding your use of Nanoreality’s mobile
games, websites, devices including all information, text, graphics, software and related
services. The Terms of Service apply to your download, access and/or use of Nanoreality
games, whether on your PC, on a mobile device, on our website or any other website,
or on any other device or platform (each a "Game" and together the
"Games"). The Terms of Service also apply to any of our other services
that we may provide in relation to the Games or the websites www.nanoreality.com and nanoreality.com (collectively and
individually, "Website/App"),
such as customer support, social media and community channels (we refer to all our Games
and other services described hereto collectively as the "Service" in
these terms).

related services. The Terms of Service apply to your download, access and/or use of
Nanoreality games, whether on your PC, on a mobile device, on our website or any other
website, or on any other device or platform (each a "Game" and together the
"Games"). The Terms of Service also apply to any of our other services that we
may provide in relation to the Games or the websites www.nanoreality.com and
nanoreality.com (collectively and individually, "Website/App"), such as
customer support, social media and community channels (we refer to all our Games and
other services described hereto collectively as the "Service" in these terms).
Use of the Service is also governed by Nanoreality’s Privacy Policy see here
www.nanoreality.com/privacy_policy. By using any of the Websites/App and the Services
offered on it, downloading any software, or browsing the Websites, as well as by
downloading any of Nanoreality’s mobile games from app stores, you accept the
following Terms of Service. If you do NOT agree to all these Terms of Service, please do
NOT use the Websites/App and/or download any of our Games.
Summary of Key Points
You should read all of these Terms of Service and also our Privacy Policy, but here are
some key points we want to draw to your attention:
• By using the Service, you accept this Terms of Service and consent to our Privacy
Policy.
• You agree to use the Service legitimately, honestly and in accordance with this
Terms of Service and any additional terms. You understand that your account, points and
any other rewards or potential rewards accumulated (if any) may (in our sole discretion)
be terminated or forfeited without any liability to you if you use the Service in a
fraudulent manner or do not use the Service legitimately, honestly and in accordance
with this Terms of Service and any additional terms. We reserve the right to review your
activity in connection with the Service to identify such actions.
• You agree to indemnify Nanoreality for claims arising from your breach of this
Terms of Service or arising from the content you submit through the Websites /App, among
other types of claims. See Section N.
• Your use of the Service is AS IS, without warranty and will result in no
liability to us. See Sections M-O.
A. Accessing, Grant of License and using our Service:
1. Before accessing or using the Service, including browsing any Nanoreality
Websites/App via computer, mobile device or otherwise or accessing a Game, you must
agree to these Terms of Service and the Privacy Policy. You may also be required to
register an account on the Service (an “Account”). By registering for an
Account or otherwise using the Service, you represent that you are age 13 or older and
you understand and agree to these Terms of Service. If you are between the ages of 13
and 17, you represent that your legal guardian has reviewed and agreed to these Terms of
Service. These Terms of Service are made available via the app store or platform that
you download our Games from, and it sets forth the terms and conditions governing your
use of the Website/App. If you are accessing the Website /App via our application
available within Apple App Store, Google Play Store, on Amazon App Store, the Windows
Phone Store, you and Nanoreality acknowledge that these Terms of Service are entered
into between you and Nanoreality and that Apple App Store, Google Play Store, on Amazon
App Store, the Windows Phone Store, is not a party to these Terms of Service. Neither
Apple nor Google are a sponsor of any Nanoreality sweepstakes, nor do they endorse this
Service or sponsor any prize redemptions. You further agree that by accessing and/or
using our Services, you are agreeing to these terms and our Privacy Policy (see Privacy
Policy www.nanoreality.com/privacy_policy ). These Terms of Service and Privacy Policy
are a legal agreement and contain important information about your rights and
obligations in relation to our Games and Services.
2. You indicate your acceptance of the Terms of Service by clicking on the "I Agree"
button (if one appears), or simply by downloading, installing or using the Service. By
doing any of these actions you have indicated that you understand the Terms of Service
and accept all of its terms. If you are accepting the terms of the Terms of Service on
behalf of a company or other legal entity, you represent and warrant that you have the
authority to bind that company or other legal entity to the terms of the Terms of
Service, and, in such event, "you" and "your" will refer to that
company or other legal entity. If you do not agree to these Terms of Service or any
future updated version of them, please do not install, use or otherwise access the
Service. If in the future update to these terms require a click to accept, then you may
not be able to continue to use the Services until you have clicked to accept the updated
terms.
3. In order to access the Websites/App, you need a compatible device. You also need
access to the Internet through a mobile data plan or an Internet subscription. You are
solely responsible for paying any service fees associated with any such access
(including data charges). You should ask your mobile operator or internet service
provider if you are unsure what these charges will be, before you access and/or use our
Services. You must provide all equipment, software and access necessary to connect to
our Service. Our Service is not available on all operating systems, devices, or
locations. You should note that depending on your device, your device might not be able
to access our Service while you are using other features of your device.
4. You are solely responsible for your interactions with other users of the Service and
any other parties with whom you interact through the Service and/or Nanoreality Games.
Nanoreality reserves the right, but has no obligation, to become involved in any way
with these disputes. You will fully cooperate with Nanoreality to investigate any
suspected unlawful, fraudulent or improper activity, including, without limitation,
granting Nanoreality access to any password-protected portions of your Account.
5. If you have a dispute with one or more users, you release us (and our officers,
directors, agents, subsidiaries, joint ventures and employees) from claims, demands and
damages (actual and consequential) of every kind and nature, known and unknown, arising
out of or in any way connected with such disputes.
6. Nanoreality reserves the right, at its discretion, to change, modify, add or remove
portions of these Terms of Service and its Privacy Policy at any time by posting the
amended terms on the Nanoreality Service. You can access the latest version of these
terms at any time at www.nanoreality.com/terms_of_service. Your continued use of our
Services after the terms have been updated shall confirm your acceptance of the updated
terms. If at any point you do not agree to any portion of the then-current version of
our Terms of Service, the Nanoreality Privacy Policy, or any other Nanoreality policy,
rules or codes of conduct relating to your use of the Service, your license to use the
Service shall immediately terminate, and you must immediately stop using the
Service.
7. The specific game rules, scoring rules, controls and guidelines for each Game can be
found within the Game itself. Such rules, scoring rules, controls and guidelines form
part of these terms and you agree that you shall comply with them in respect of each
individual Game which you choose to access and/or play.
8. There may also be times when our Services or any part of them are not available for
technical or maintenance related reasons, whether on a scheduled or unscheduled
basis.
B. Rewards Programs
1. Overview. Nanoreality shall offer rewards in the form of gift cards (“Gift
Cards”) under which you may earn points that can be redeemed for rewards (each a
"Reward"). Not all of our Service include a Rewards program, and Rewards may
include additional terms. To participate in and be able to redeem a Reward, you must be
a legal resident of a jurisdiction where your participation is legal pursuant to the
terms hereof, is possible to participate and redeem Gift Cards, and does not create any
liability or registration, bonding, tax or other affirmative obligation for us), and
agree to this Terms of Service. For avoidance of any doubt a Reward shall only be
redeemed in countries pursuant to which the Gift Cards are issued. Any points earned
outside of the locations listed are not eligible for redemption. Reward is void where
prohibited by law and if the user resides outside the aforementioned countries.
Additional terms may apply to your participation in activities allowing you to earn
points ("Activities"). Nanoreality may limit or restrict your ability to
participate in a Reward program in its sole discretion and may void your points and any
Rewards or potential Rewards you have accumulated in a Reward program if you do not
comply with the Terms of Service or any applicable additional terms. You agree to abide
by the final and binding decisions of Nanoreality regarding a Reward program and your
participation in it. Nanoreality may change, suspend or cancel a Reward program at any
time without notice including any points you may have accrued. Nanoreality has the right
to end a Reward program by providing six (6) months notice to the e-mail address you
provided when you registered for a Reward program or last updated your account.
2. Registration. To participate in a Reward program and redeem points, you must register
with the applicable Website/App. Only one account is permitted per person. To redeem and
receive Rewards, you may be required to provide your real name, phone number, mailing
address, e-mail address, Social Security (where applicable) number for tax purposes and
